Service changes: when a phone call changes the contract
Most hauling agreements let you and the hauler change the containers, frequency and price by mutual agreement, and many say that agreement can be shown by a phone call or by paying the next invoice. Some changes can also be written up as a new agreement with a new term.
How do service changes get agreed?
Republic's published terms say the parties may change the type, size or amount of equipment, the type or frequency of service, and the charges, by mutual agreement shown verbally, in writing, by paying the invoice or by the parties' actions, and that the agreement continues in force as adjusted.[1] WM's terms likewise allow changes orally, in writing or by conduct, and treat failing to object to a written notice as consent.[2]
So the record of what you agreed is often the invoice, not a signed document.
Can a change restart the term?
It can, depending on the wording and on what you sign. A change made with a new service agreement or a new signature page may carry a new initial term. Sacramento's franchise customers have protection here: Republic's terms say that inside those franchise areas, a service-level change leaves the term intact and doesn't start it over.[1] Outside them, read before you sign anything a driver or sales rep brings, and ask in writing whether the term changes.
Should you change service mid-term?
Right-sizing is usually worth doing: if containers go out half full, fewer pickups or a smaller container cut the bill. See container sizes and service levels. Do it with the term protected in writing, and check that the monthly price on the next invoice matches what you were told.
Questions buyers ask
- Does adding a dumpster restart my waste contract?
- It can if the change is documented as a new agreement. Ask in writing whether the term changes before you agree, and confirm it by email afterwards.
- Can my hauler change my service without a signature?
- Published terms from both large haulers allow changes agreed verbally or by conduct, such as paying the invoice. Confirm every change in writing.
